This is a saga that ran for nearly two decades, so here's the arc and where it landed:
The background
Hyperion Entertainment develops AmigaOS 4.x. Its rights trace back to a 2009 settlement with Amiga Inc., Itec LLC, and Amino Development, which gave Hyperion sole ownership of AmigaOS 4 and an exclusive, perpetual, worldwide right to develop, modify, commercialize, and market AmigaOS 4.x and future versions under the AmigaOS trademark and associated marks like the Boing Ball logo.
Round two: Cloanto's 2017 suit
That peace didn't last. In December 2017, Cloanto Corporation filed a claim attempting to invalidate and diminish the exclusive rights Hyperion had been granted under the 2009 settlement. Cloanto (later joined by "the Amiga Parties" — Amiga Inc., Itec, and Amino) argued Hyperion had exceeded the rights granted to it by the 2009 agreement, amounting to copyright and trademark infringement. This dragged on for years, through depositions and procedural motions (e.g. a 2021 dispute over testimony from Hyperion co-founder Evert Carton).
The 2023 ruling
In April 2023, Hyperion won decisively: the US District Court for the Western District of Washington dismissed all remaining claims and found entirely in favor of Hyperion, granting its motion for summary judgment on every count.
A separate, later dispute — and final resolution
Despite that win, litigation between the parties apparently continued in some form, because Amiga Inc. was sued again by Hyperion in 2018. That matter, plus anything else outstanding, was finally put to rest: in August 2026, Hyperion Entertainment BV and Amiga Corporation reached a new settlement agreement ending all ongoing legal disputes between the parties, with Hyperion's director Timothy De Groote saying the goal from the start of his ownership was to end the lawsuits that had drained energy and resources from AmigaOS's development.

Bottom line: Hyperion has repeatedly prevailed or settled in its favor, retains its rights to develop and sell AmigaOS, and as of August 2026 the long-running legal war between Hyperion and the various Amiga-brand entities is officially over.
